Anderson County Dog Bite Attorneys
Dog bites are frightening and dangerous, especially if the victim is a child. These injuries are often serious and are costly—not just in medical bills but also in pain and emotional suffering. Pursuing a personal injury claim against the dog’s owner is typically the best way to obtain compensation for these injuries. Seasoned Anderson County dog bite attorneys can help you with a claim.
South Carolina’s Strict Liability Laws
South Carolina has a strict-liability law. Under this statute, dog owners are responsible for damages incurred by someone bitten or attacked by their dog. Neither the bite victim nor their attorney must establish that the owner knew or should have known that the dog was dangerous. The dog’s owner is already presumed liable under the law.
In contrast, some other states have a “one-bite rule.” This law requires the dog bite victim or their lawyer to prove that the dog’s owner knew the dog was dangerous. In simple terms, the dog gets one bite “free” before the owner will be held liable in states with a one-bite rule.
However, this isn’t the case in South Carolina. South Carolina laws protect dog attack victims more than states with the one-bite rule and make for a clearer liability case.
